Supplementary rental conditions yachts The Netherlands

 

1. RENTAL 

1.a Renting takes place between the owner of the ship and the tenant.

 

1.b Renting occurs conform the ANWB edited leasing contract of pleasure vessels and conform the supplementary terms of employment from zeilschipverhuur.nl.

 

1.C When the ANWB edited leasing contract is in contrast with the supplementary terms of employment form zeilverschipverhuur.nl we are applying the terms of employment from the ANWB in question.

 

2. RESERVATION

 

2.a A reservation is definitive when the owner of the ship returns the rental contract filled in completely and signed. When the amount of 50% of the total rental sum is payed and is visible on the account of the owner of the ship.

 

2.b Reservations have to be made by filling in the form and signing the rental contract.

 

2.c The reservation form has to be sent to the owner of the ship joined by a copy of the passport from the tenant.

 

3. DETERMINATION

 

3.a After receiving the reservation form, the owner of the ship gives the tenant until the first payment an option on the desirable vessel.

 

3.b The tenant receives the rental contract twice. One copy is for the tenant.

 

3.c The rental contract has to be filled in and returned to the owner of the ship within 10 days.

 

4. PAYMENT

 

4.a After receiving the rental contract, 50% of the total rental sum has to be payed within 7 days. The next 50% has to be payed before three weeks of departing.

 

4.b A reservation within 3 weeks before leaving, the total rental sum has to be payed once after signing the rental contract.

4.c Administration costs are included in the total rental sum.

 

4.d. The pledge is not included in the total rental sum. You have to pay the pledge before starting the rental period to the owner of the ship.

 

5. ANNULMENT

At annulment is chargeable:

- of untill 12 weeks before the hiring period: 15% of the total rental sum

- of 12 weeks up to 8 weeks before the hiring period: 50% of the total rental sum.

-  of 8 weeks up to 4 weeks before the hiring period: 70% of the total rental sum.

- from 4 weeks up to including 1 day before the hiring period: 90% of the total rental sum.

- As for the day of leaving: 100%.

 

6. DISSOLUTION OF THE RENTAL CONTRACT

The owner can dissolve the rental contract when the tenant shows unavailability of sailing and navigating the vessel, without giving the tenant any refund or restitution of the rental sum.

 

COMPLAINTS

 

7.a Complaints according to the procedure of the owner and complaints according to the technical state of the ship, inventory and equipment have to be reported to the owner.

 

7.b Complaints have to be reported to the owner within 24 hours.

 

8. TRANSFER

 

8.a The tenant is obliged to present the ship in a technical good state, with the usual equipment, the required rescue equipment and the required inventory at the beginning of the rental period.

 

8.b. De tenant legitimises twice before the journey at the owner. For example a passport and a drivers license.

 

8.c The owner has to make the tenant attentive on possible damages and or lacks before the hiring period.

 

8.d. The ship is presented clean with filled water-, gas- and fuel tanks.

 

8.e The tenant has to verify the ship by the present inventory list and checking list before taking over. By acceptation the inventory list and the checking list have to be signed by the tenant.

 

REFUND

 

9.a The tenant has to hand in the ship with full water tanks. The owner fills the fuel tank.

 

9.b The ship is brought back to the port of call by the tenant swiftly before the hiring period has expired.

 

9.c. When the tenant leaves the ship behind at another place than the port of call, the cost for transport and delay are at the expense of the tenant.

 

9.d Damages developed by the tenant during the hiring period have to be reported to the owner. Damage will be deducted on the guarantee sum.

 

9.e The tenant has to be compensated for lost material during the rental period.

 

9.f The ship is transferred to the tenant by the inventory- and checking list.

 

10 PERMITTED SAILING AREA

 

10.a the sailing area includes the by the insurance stipulated insurance area. Extension of this sailing area is only possible when there is a written and signed rental contract.

 

 

11. DAMAGE OR BREAKDOWN

 

11.a In case of damage, or breakdown the tenant has to report the owner immediately as soon as possible.

 

11.b The owner has to inform his insurance company immediately in case of damage, before the ship has to be examined and convalescence takes place.

 

11.c In case of any damage or breakdown the tenant is responsible for consistency damage, the costs of salvation, rescue and any form of towing. Therefore claimed compensations are at the expense of the tenant unless the damage can not be attributed to the tenant and the damage is covered by the actual insurance of the ship. The tenant has to be very accurate in accepting some help.

 

11.d If a repair of more than 24 hours is necessary, caused by damage, developed by wear and/or insufficient maintenance the tenant has the right to a proportional repayment of the hiring sum over the period he couldn’t sail with the ship.

 

12 GENERAL

 

12. a Is is not permitted to the tenant, unless with a written authorisation of the owner:

- to stay on board with more crew members than has given up on the reservation form.

- to take part in games

- to keep house animals

- change the ship and equipment

- to sail in unfavourable circumstances or unfavourable weather forecast circumstances

- to sail at night, excluding journeys at sea.

- to sublease the ship or give submission of the ship to others.

- to have telephone conversations by marifoon

- to drag other vessels

 

12.b Costs, which are direct related to the use of the ship, such as port-, bridge-, quay- , lock- and harbour costs are at the expense of the tenant.

12.c The tenant explains being a ‘good captain’ for the ship, knowing the rules on the water and observe these rules.
